Plaintiff claimed an injunction restraining the defendant from removing shingle, sand, etc. from the foreshore, which, he said, formed a mutual barrier protecting his property from the sea. It was alleged that the defendant had removed shingle, etc., from the seashore in November and December, 1937, and January to the detriment of the plaintiff's property. His lordship granted the injunction, and gave judgement for damages to be assessed and costs."
